4320 - Use of School Buses by Government Agencies

It is the policy of Edmonds School District that district-owned school buses may be rented or leased to governmental agencies for the purpose of transporting personnel, supplies and/or evacuees. A written rental or lease agreement may be executed by the superintendent or his/her designee only after the State Director of Civil Defense or any of his/her authorized agents has at the request of government agency declared that an emergency exists and that the district's buses are needed, provided that no specific interlocal agreement with such agency already exists for use of the buses. The government agency renting or leasing the school buses must agree in writing to reimburse the school district for all costs, expenses and damage related to such use and also must provide an indemnity agreement protecting the district form any liability arising out of the agency's use of school buses, including all legal costs incident to claims arising from such use. The district may use the "Emergency School Bus Lease Agreement" form developed by the Washington State School Directors Association for contracts resulting from the implementation of this policy.
